KOTCH&THEGANG – EI MANON DONNEZ, 73 grande rue Saint Michel 31400 Toulouse , organise un jeu gratuit sans obligation d’achat ouvert du 18/12/2023 à 16h au 23/12/2023 à 23h59, heure de Paris.

Article 2 : Site, dates et horaires du jeu-concours 

Le jeu concours ci-après le “jeu”se déroulera sur le réseau social Instagram via le compte instagram @kotchandthegang et sur le réseau social Facebook via le compte KOTCH&THEGANG. La promotion n’est pas gérée ou sponsorisée par Instagram ou Facebook. En participant au jeu, les participants acceptent la politique de confidentialité de KOTCH&THEGANG-EI MANON DONNEZ consultable sur www.kotchandthegang.com et reconnaissent que la promotion de ce jeu n’est pas gérée ou sponsorisée par Instagram ou Facebook.

Toute participation doit être finalisée et validée avant le 23/12/2023 à 23h59, heure de Paris. Le tirage au sort du gagnant aura lieu le 24/12/2023 à 10h00, heure de Paris. Par la suite, le gagnant sera contacté sur la messagerie d’Instagram et/ou Facebook. Le gagnant sera mentionné dans la story (durée story : 24h) Instagram ( @kotchandthegang) et/ou Facebook (KOTCH&THEGANG) le 24/12/2023. 

Les participants ne pourront participer qu’une seule fois, sur Instagram ou sur Facebook.

Article 3 : Participants

Ce jeu gratuit sans obligation d’achat est exclusivement ouvert aux personnes résidant en France métropolitaine et en Europe. Toute participation au jeu nécessite un accès internet et une adresse électronique valide.

Sont exclues du jeu les personnes ne répondant pas aux conditions énoncées dans le présent règlement ainsi que toute personne ayant directement ou indirectement participé à la conception, à la réalisation ou à la gestion du jeu ainsi que leur conjoint et les membres de leurs familles : ascendants et descendants directs ou autres parents vivant ou non sous leur toit. 

Il n’est autorisé qu’une seule participation par personne. Toute participation est strictement nominative et le participant ne peut en aucun cas jouer pour le compte d’autres participants. KOTCH&THEGANG – EI MANON DONNEZ se réserve le droit de procéder à toute vérification utile pour assurer le respect de cette règle.

KOTCH&THEGANG – EI MANON DONNEZ se réserve le droit de demander à tout participant de justifier des conditions ci-dessus exposées. Toute personne ne remplissant pas ces conditions ou refusant de les justifier sera exclue du jeu et ne pourra, en cas de gain, bénéficier de son gain.

La participation au jeu implique l’entière acceptation du présent règlement, ainsi que les lois et règlements français applicables en la matière.

Article 4 : Modalités de participation

Les participants peuvent tenter leur chance en se rendant sur Instagram ou Facebook ; une seule participation par personne est possible pendant le Jeu. 

Afin de participer au jeu, le participant doit remplir les conditions suivantes :

Le lot sera exclusivement offert à un (1) gagnant du présent jeu-concours et attribué conformément à l’article 6 du présent règlement.

Description du lot : un (1) manteau mixte d’une valeur de cent quarante euros (140 €) Toutes taxes incluses. Le gagnant peut choisir la taille qu’il souhaite. Possibilité de tailles :

Article 6 : Désignation du gagnant

Un tirage au sort sera effectué le 24/12/2023 à 10h00, heure de Paris, en vue de désigner le gagnant qui remportera le lot mis en jeu et mentionné à l’article 5 du présent règlement. Les participants sont informés que le tirage au sort concernera l’intégralité des soumissions réalisées dans le cadre du jeu-concours et conformément au présent règlement.

Le 24/12/2023 à 10h00, KOTCH&THEGANG – EI MANON DONNEZ sélectionnera le gagnant par tirage au sort. KOTCH&THEGANG – EI MANON DONNEZ  garantit aux participants l’impartialité, la bonne foi et la loyauté de l’entreprise individuelle. Sa décision est sans appel.

L’entreprise individuelle organisatrice se réserve le droit de disqualifier les participants qui ne respectent pas les conditions générales du concours.

Article 7 : Annonce du gagnant

Le gagnant sera contacté par KOTCH&THEGANG – EI MANON DONNEZ  via message privé sur Instagram ou Facebook. KOTCH&THEGANG – EI MANON DONNEZ n’est pas responsable en cas de fourniture de données incomplètes ou en cas de suppression ou de perte d’email ou de messages, ou en cas de dysfonctionnement des réseaux sociaux concernés. Le gagnant accepte que son compte Instagram ou Facebook soit mentionné dans la story (durée 24 heures) instagram de @kotchandthegang et facebook KOTCH&THEGANG du 24/12/2024

Article 8 : Remise du Gain

KOTCH&THEGANG – EI MANON DONNEZ  enverra un message au gagnant sur la messagerie d’Instagram ou Facebook afin de lui indiquer les modalités pour bénéficier du gain. Le gain sera envoyé sous forme de colis par voie postale. Le gagnant devra communiquer toutes les informations nécessaires à cet envoi (Nom, Prénom, adresse postale, adresse mail, numéro de téléphone). KOTCH&THEGANG – EI MANON DONNEZ ne sera pas responsable en cas de perte ou de vol du colis et en cas d’informations erronées concernant les coordonnées du gagnant. En cas de retour du colis avec le gain, celui-ci restera disponible pour un nouvel envoi pendant quinze jours. Au delà de ces quinze jours, le gain ne sera plus disponible. 

Le lot est valable jusqu’au 30/01/2024. Il sera envoyé par voie postale en France ou en Europe avant le 30/01/2024.

Le gain est accepté tel qu’il est annoncé. Il ne pourra être ni échangé contre sa valeur en espèces ou contre tout bien ou prestation quelconque, ni repris, ni faire l’objet d’une contrepartie ou d’un équivalent financier. Aucun changement (de date, de prix etc.) pour quelque raison que ce soit ne pourra être demandé à KOTCH&THEGANG – EI MANON DONNEZ. Il est précisé que KOTCH&THEGANG – EI MANON DONNEZ ne fournira aucune prestation ni garantie, le gain consistant uniquement en l’offre d’un manteau mixte d’une valeur de cent quarante euros décrit à l’article 5 du présent réglement. 

En tout état de cause, l’accès au gain se fera selon les modalités communiquées par KOTCH&THEGANG – EI MANON DONNEZ au gagnant sur la messagerie d’Instagram ou Facebook. Le participant est seul responsable de son gain et de son utilisation.

Article 9 : Responsabilité du participant

Les participants s’engagent à participer au jeu-concours de manière loyale et de bonne foi.

Toute participation effectuée contrairement aux dispositions du présent règlement entraînera une disqualification et l’impossibilité de remporter le gain éventuellement attribué. Tout participant suspecté de fraude pourra être exclu du jeu-concours par KOTCH&THEGANG – EI MANON DONNEZ sans que KOTCH&THEGANG – EI MANON DONNEZ  n’ait à en justifier. Plus généralement, toute tentative de perturbation du processus normal du déroulement du jeu-concours entraînera une disqualification du participant. Toute identification ou participation incomplète, erronée ou illisible, volontairement ou non, ou réalisée sous une autre forme que celle prévue dans le présent règlement sera considérée comme nulle.

Article 10 : Utilisation des données personnelles des participants

Conformément aux dispositions de la Loi Informatique et Libertés du 6 janvier 1978 modifiée par la loi du 6 août 2004, les informations collectées pour participer au jeu-concours sont exclusivement destinées à KOTCH&THEGANG – EI MANON DONNEZ. Les données collectées à cette fin sont obligatoires pour participer au jeu. Par conséquent, les personnes qui souhaiteraient supprimer ces données avant la fin du jeu ne pourront pas y participer. Tout participant au jeu dispose par ailleurs d’un droit d’accès, de rectification et de suppression des données le concernant sur simple demande écrite par courrier à KOTCH&THEGANG – EI MANON DONNEZ dont l’adresse est mentionnée à l’article 1.

Le gagnant autorise KOTCH&THEGANG – EI MANON DONNEZ à mentionner son compte Instagram ou Facebook sur la story instagram (@kotchandthegang) et facebook (KOTCH&THEGANG) du 24/12/2024 du sans que cela ne lui confère une rémunération, un droit ou un avantage quelconque, autre que l’attribution de son gain. 

Article 11 : Jeu sans obligation d’achat

En l’état actuel des offres de service et de la technique, la majorité des fournisseurs d’accès à Internet offre une connexion gratuite ou forfaitaire aux internautes. Il est donc expressément précisé que tout accès au jeu-concours (tels que notamment connexion par câble, fibres, ADSL ou liaison spécialisée) ne pourra donner lieu à aucun remboursement, dans la mesure où l’abonnement aux services du fournisseur d’accès est contracté par l’internaute pour son usage de l’Internet en général et que le fait pour le joueur de se connecter au site ou aux réseaux sociaux de KOTCH&THEGANG – EI MANON DONNEZ et de participer au jeu ne lui occasionne aucun frais ou débours supplémentaire. Aucun remboursement des frais éventuels de participation au jeu ne pourra être effectué.  

Article 12 : Règlement du jeu

Le présent règlement est disponible en cliquant sur le lien présent dans le post du jeu sur l’Instagram @kotchandthegang et sur le post du jeu sur le Facebook KOTCH&THEGANG et pourra être envoyé par mail gratuitement à toute personne qui en fait la demande via le formulaire de contact du site internet www.kotchandthegang.com

KOTCH&THEGANG – EI MANON DONNEZ se réserve le droit de prolonger, écourter, modifier ou annuler le jeu à tout moment, notamment en cas de force majeure, sans qu’il puisse être prétendu à aucune indemnité par les participants.

Article 13 : Propriété intellectuelle

La reproduction, la représentation ou l’exploitation de tout ou partie des éléments composant le jeu, le présent règlement y compris sont strictement interdites.

Toutes les marques, logos, textes, images, vidéos et autres signes distinctifs reproduits sur le site et/ou les réseaux sociaux ainsi que sur les sites auxquels celui-ci permet l’accès par l’intermédiaire de liens hypertextes, sont la propriété exclusive de leurs titulaires et sont protégés à ce titre par les dispositions du Code de la propriété intellectuelle et ce pour le monde entier. Leur reproduction non autorisée constitue une contrefaçon passible de sanctions pénales.

Article 14 : Responsabilité de KOTCH&THEGANG – EI MANON DONNEZ

La participation au jeu-concours implique la connaissance et l’acceptation de caractéristiques et des limites du réseau internet, notamment en ce qui concerne les performances techniques, les temps de réponse pour consulter, interroger ou transférer des informations, les risques d’interruption, les risques liés à la connexion, l’absence de protection de certaines données contre des détournements éventuels et les risques de contamination par d’éventuels virus circulant sur le réseau. KOTCH&THEGANG – EI MANON DONNEZ ne pourra être tenue responsable, notamment, des dysfonctionnements pouvant affecter le réseau Internet, pour tout problème de configuration ou lié à un navigateur donné.

KOTCH&THEGANG – EI MANON DONNEZ ne garantit pas que le site Internet  / Réseau social  à partir duquel le jeu-concours est accessible fonctionne sans interruption, qu’il ne contienne pas d’erreurs informatiques ou des défauts. La responsabilité de KOTCH&THEGANG – EI MANON DONNEZ ne pourra être engagée sur ce fondement.

Elle ne pourra pas davantage être tenue pour responsable des dysfonctionnements techniques du jeu-concours, si les participants ne parvenaient pas à se connecter au site du jeu-concours ou à jouer, si les données relatives à l’inscription ne parvenaient pas pour une raison quelconque non imputable à KOTCH&THEGANG – EI MANON DONNEZ, lui arriveraient illisibles ou impossibles à traiter ou en cas de problèmes d’acheminement du courrier électronique. Les participants ne pourront prétendre à aucun dédommagement à ce titre. KOTCH&THEGANG – EI MANON DONNEZ ne sera pas non plus responsable de l’utilisation des réseaux sociaux par le participant (qui se doit d’être conforme aux réglementations applicables) ou en cas de dysfonctionnement des réseaux sociaux.

La participation au jeu-concours est de la seule responsabilité des participants. KOTCH&THEGANG – EI MANON DONNEZ ne saurait être tenue responsable de tout dommage, matériel ou immatériel causé aux participants, à leurs équipements informatiques et aux données qui y sont stockées, ou toutes conséquences directes ou indirectes pouvant découler, notamment de leur activité personnelle, professionnelle ou commerciale.

KOTCH&THEGANG – EI MANON DONNEZ ne saurait encourir une quelconque responsabilité si, en cas de force majeure, elle était amenée à annuler le présent jeu, à l’écourter, le proroger, le reporter ou en modifier les conditions. Dans tous les cas, elle se réserve la possibilité de prolonger la période de participation. Ces changements feront toutefois l’objet d’une information préalable par tous les moyens appropriés.

KOTCH&THEGANG – EI MANON DONNEZ ne saurait être tenue pour responsable des retards, pertes, vols, avaries des courriers, manque de lisibilité des cachets du fait des services postaux. Elle ne saurait non plus être tenue pour responsable et aucun recours ne pourra être engagé contre elle en cas de survenance d’événements présentant les caractères de force majeure (grèves, intempéries…), cas fortuits ou faits d’un tiers, privant notamment partiellement ou totalement les participants de la possibilité de participer au jeu et/ou le gagnant du bénéfice de leur gain.

KOTCH&THEGANG – EI MANON DONNEZ ainsi que ses prestataires et partenaires ne pourront en aucun cas être tenus pour responsables des éventuels incidents pouvant intervenir sur le gain par les bénéficiaires dès lors que le gagnant en aura pris possession. De même KOTCH&THEGANG – EI MANON DONNEZ, ainsi que ses prestataires et partenaires, ne pourront être tenus pour responsables de la perte ou du vol du gain par les bénéficiaires dès lors que le gagnant en aura pris possession. Le gagnant est seul responsable de son gain et de son utilisation.

Article 15 : Litige & Réclamation

Le présent règlement est régi par la loi française.

KOTCH&THEGANG – EI MANON DONNEZ se réserve le droit de trancher sans appel toute difficulté pouvant survenir quant à l’interprétation ou à l’application du présent règlement, étant entendu qu’aucune contestation ne sera admise notamment sur les modalités du jeu, sur les résultats, sur les gains ou leur réception, un mois après la fin du jeu. Toute réclamation doit être adressée dans le mois suivant la date de fin du jeu à KOTCH&THEGANG – EI MANON DONNEZ. Passée cette date, aucune réclamation ne sera acceptée. Il est convenu que les informations résultant des systèmes de jeu de KOTCH&THEGANG – EI MANON DONNEZ ont force probante dans tout litige quant aux éléments de connexion et au traitement informatique desdites informations relatives au jeu.

De convention expresse entre le participant et KOTCH&THEGANG – EI MANON DONNEZ, seuls les systèmes et fichiers informatiques KOTCH&THEGANG – EI MANON DONNEZ feront foi.

Il est en conséquence convenu que KOTCH&THEGANG – EI MANON DONNEZ pourra se prévaloir, notamment aux fins de preuve de tout acte, fait ou omission, des programmes, données, fichiers, enregistrements, opérations et autres éléments (tels que des rapports de suivi ou autres états) de nature ou sous formats ou supports informatiques ou électroniques, établis, reçus ou conservés directement ou indirectement par KOTCH&THEGANG – EI MANON DONNEZ.

Article 16 : Droit applicable

Le présent règlement est soumis à la loi française. En cas de désaccord persistant sur l’application du présent règlement, la contestation sera soumise à l’appréciation souveraine des tribunaux français compétents.

La version originale en français de ce règlement peut avoir été traduite dans d’autres langues. La traduction est réalisée pour votre information. En effet, en cas de litige sur le contenu ou l’interprétation du présent règlement ou en cas d’incohérence ou de divergence entre la version française et toute autre version en langue étrangère de ce celui-ci, c’est la version en français qui prévaudra. La version française est disponible sur notre site internet (en sélectionnant la langue française) ou pourra vous être envoyée sur demande par email.

Si l’une des dispositions du présent règlement était invalidée, vous serez toujours soumis aux autres dispositions de ce règlement. Dans un tel cas, la disposition invalidée sera néanmoins appliquée dans la mesure où la loi le permet en tenant compte du contenu et de l’objectif de ce règlement.

Article 2: Platform, Dates, and Contest Hours

The contest, hereinafter referred to as the “contest,” will take place on the Instagram social network via the @kotchandthegang Instagram account and on the Facebook social network via the KOTCH&THEGANG account. The promotion is not managed or sponsored by Instagram or Facebook. By participating in the contest, participants agree to the privacy policy of KOTCH&THEGANG-EI MANON DONNEZ, which can be found at www.kotchandthegang.com, and acknowledge that the promotion of this contest is not managed or sponsored by Instagram or Facebook. All entries must be completed and validated before 23/12/2023 at 11:59 PM, Paris time. The winner will be drawn on 24/12/2023 at 10:00 AM, Paris time. Subsequently, the winner will be contacted on Instagram and/or Facebook. The winner will be mentioned in the Instagram story (story duration: 24 hours) @kotchandthegang and/or Facebook (KOTCH&THEGANG) on 24/12/2023. Participants can only participate once, either on Instagram or Facebook.

Article 3: Participants

This free contest, with no purchase necessary, is exclusively open to individuals residing in metropolitan France and Europe. Participation in the contest requires internet access and a valid email address. Excluded from the contest are individuals who do not meet the conditions stated in this regulation, as well as anyone who has directly or indirectly participated in the conception, realization, or management of the contest, including their spouse and family members: ascendants and descendants, whether living with them or not. Only one entry is allowed per person. Participation is strictly personal, and the participant cannot play on behalf of other participants. KOTCH&THEGANG – EI MANON DONNEZ reserves the right to verify compliance with this rule.

KOTCH&THEGANG – EI MANON DONNEZ reserves the right to request that any participant justify the above conditions. Anyone who does not meet these conditions or refuses to justify them will be excluded from the contest and will not be able to receive the prize in case of winning. Participation in the contest implies full acceptance of this regulation, as well as French laws and regulations applicable in this matter.

Article 4: Participation Terms

Participants can try their luck by visiting Instagram or Facebook ; only one entry per person is allowed during the contest. To participate in the contest, the participant must meet the following conditions:

The prize will be exclusively offered to one (1) winner of this contest and awarded in accordance with Article 6 of this regulation. Article 6: Winner Selection

A random draw will be conducted on 24/12/2023 at 10:00 AM, Paris time, to determine the winner who will receive the prize mentioned in Article 5 of this regulation. Participants are informed that the draw will cover all submissions made in the context of the contest and in accordance with this regulation. On 24/12/2023 at 10:00 AM, KOTCH&THEGANG – EI MANON DONNEZ will select the winner by a random draw. KOTCH&THEGANG – EI MANON DONNEZ guarantees the impartiality, good faith, and loyalty of the individual company. Its decision is final. The organizing individual company reserves the right to disqualify participants who do not comply with the general conditions of the contest.

Article 7: Announcement of the Winner

The winner will be contacted by KOTCH&THEGANG – EI MANON DONNEZ via private message on Instagram or Facebook. KOTCH&THEGANG – EI MANON DONNEZ is not responsible in case of incomplete data provision, or in case of deletion or loss of email or messages, or in case of malfunction of the relevant social networks. The winner agrees to have their Instagram or Facebook account mentioned in the Instagram story (@kotchandthegang) and Facebook (KOTCH&THEGANG) on 24/12/2024.

Article 8: Prize Delivery

KOTCH&THEGANG – EI MANON DONNEZ will send a message to the winner on the Instagram or Facebook messaging system to provide details on how to claim the prize. The prize will be sent as a package by postal mail. The winner must provide all necessary information for this shipment (Name, First Name, postal address, email address, phone number). KOTCH&THEGANG – EI MANON DONNEZ will not be responsible for the loss or theft of the package and in case of incorrect information regarding the winner’s contact details. In case of return of the package with the prize, it will remain available for a new shipment for fifteen days. Beyond these fifteen days, the prize will no longer be available. The prize is valid until 30/01/2024. It will be sent by postal mail in France or Europe before 30/01/2024. The prize is accepted as announced. It cannot be exchanged for its cash value or for any goods or services, nor can it be returned or exchanged for any financial consideration. No changes (date, price, etc.) for any reason can be requested from KOTCH&THEGANG – EI MANON DONNEZ. It is specified that KOTCH&THEGANG – EI MANON DONNEZ will provide no services or guarantees, as the prize consists solely of the offer of a unisex coat valued at one hundred forty euros, as described in Article 5 of this regulation. In any case, access to the prize will be according to the modalities communicated by KOTCH&THEGANG – EI MANON DONNEZ to the winner on Instagram or Facebook messaging. The participant is solely responsible for their prize and its use.

Article 9: Participant’s Responsibility

Participants agree to participate in the contest fairly and in good faith. Any participation contrary to the provisions of this regulation will result in disqualification and the impossibility of winning any prize. Any participant suspected of fraud may be excluded from the contest by KOTCH&THEGANG – EI MANON DONNEZ without the need for justification. More generally, any attempt to disrupt the normal course of the contest will result in the disqualification of the participant. Any incomplete, incorrect, or illegible identification or participation, whether intentional or not, or performed in a form other than that provided for in this regulation, will be considered null and void.

Article 10: Use of Participants’ Personal Data

In accordance with the provisions of the Data Protection Act of January 6, 1978, modified by the law of August 6, 2004, the information collected to participate in the contest is exclusively intended for KOTCH&THEGANG – EI MANON DONNEZ. The data collected for this purpose is mandatory to participate in the contest. Therefore, individuals who wish to delete this data before the end of the contest cannot participate. Any contest participant also has the right to access, rectify, and delete their data by making a written request by mail to KOTCH&THEGANG – EI MANON DONNEZ, whose address is mentioned in Article 1. The winner authorizes KOTCH&THEGANG – EI MANON DONNEZ to mention their Instagram or Facebook account in the Instagram (@kotchandthegang) and Facebook (KOTCH&THEGANG) story on 24/12/2024 without conferring any compensation, right, or advantage other than the award of their prize.

Article 11: No Purchase Necessary

Given the current state of service offerings and technology, most Internet service providers offer free or flat-rate connectivity to Internet users. It is expressly stated that any access to the contest (such as cable, fiber, ADSL, or specialized link connection) will not lead to any refund, as the subscription to the services of the access provider is contracted by the Internet user for their general use of the Internet, and the fact that the player connects to the site or social networks of KOTCH&THEGANG – EI MANON DONNEZ and participates in the contest does not incur any additional fees. No refund of any potential participation fees for the contest will be made.

Article 12: Contest Regulation

This regulation is available by clicking on the link in the contest post on Instagram @kotchandthegang and on the contest post on Facebook KOTCH&THEGANG and can be sent by email free of charge to anyone who requests it via the contact form on the website www.kotchandthegang.com. KOTCH&THEGANG – EI MANON DONNEZ reserves the right to extend, shorten, modify, or cancel the contest at any time, especially in the event of force majeure, without any claims for compensation by the participants.

Article 13: Intellectual Property

The reproduction, representation, or exploitation of all or part of the elements composing the contest, this regulation included, is strictly prohibited. All trademarks, logos, texts, images, videos, and other distinctive signs reproduced on the site and/or social networks as well as on the sites accessible through links are the exclusive property of their owners and are protected as such by the provisions of the Intellectual Property Code for the entire world. Unauthorized reproduction constitutes infringement punishable by criminal sanctions.

Article 14: KOTCH&THEGANG – EI MANON DONNEZ’s Liability

Participation in the contest implies knowledge and acceptance of the characteristics and limitations of the Internet network, especially regarding technical performance, response times for consulting, questioning, or transferring information, risks of interruption, risks related to connection, lack of protection for certain data against possible diversion, and risks of contamination by possible viruses circulating on the network. KOTCH&THEGANG – EI MANON DONNEZ cannot be held responsible, notably for malfunctions affecting the Internet network, for any configuration problems or related to a given browser. Article 15: Dispute & Complaint

This regulation is governed by French law. KOTCH&THEGANG – EI MANON DONNEZ reserves the right to definitively settle any difficulty that may arise regarding the interpretation or application of this regulation, provided that no dispute will be accepted, especially on the terms of the contest, results, prizes, or their receipt, one month after the end of the contest. It is consequently agreed that KOTCH&THEGANG – EI MANON DONNEZ may invoke, especially for proof of any act, deed, or omission, the programs, data, files, records, operations, and other elements (such as monitoring reports or other statements) of a nature or in formats or media computer or electronic, established, received, or kept directly or indirectly by KOTCH&THEGANG – EI MANON DONNEZ.

This regulation is subject to French law. In the event of persistent disagreement regarding the application of this regulation, the dispute will be submitted to the sovereign judgment of the competent French courts.

If any provision of this regulation is invalidated, you will still be subject to the other provisions of this regulation. In such a case, the invalidated provision will nevertheless be applied to the extent permitted by law, taking into account the content and purpose of this regulation.
